Jury Upholds $800,000 Award in Arkansas Jail Medical Neglect Case

The Eighth Circuit Court of Appeals in Arkansas recently affirmed an Eight Hundred Thousand Dollars ($800,000)award after an inmate, Linda Warner, died because her appendix ruptured while she was in jail custody. The court backed the final judgment for the family in the case of Turner v. Stewart. The decision highlights the legal consequences when a detention facility fails to provide proper medical care to an inmate.

 

What Happened

Warner was confined at the Faulkner County Detention Center in 2017. She repeatedly complained about her abdominal pain to jail medical staff. According to court filings, despite her symptoms, the medical staff did not properly evaluate her condition. As a result, her appendix ruptured and led to sepsis. Warner died on November 22, 2017. Her estate filed suit against the jail, county, and the jail's physician, claiming that lack of medical attention violated her constitutional rights and eventually led to her death.

At trial, the jury awarded $1.3 million in damages. However, because some parties had already settled for Five Hundred Thousand Dollars, the judge reduced the award against the doctor to Eight Hundred Thousand Dollars. The physician asked the court to overturn the judgment. After appeals, the Eighth Circuit still upheld the award.
